This Notice applies to the processing of Personal Data by Duco pursuant to your use of the Duco Installer Application (the “Application”).

We take our obligation to protect your privacy seriously!

That’s why we provide you with this 2 minute-read summary, informing you in no time on how we process your Personal Data through the Application.

What you should know:

First of all : you always remain in control of your data.

What information do we collect about you?

  • Your identification and contact details, such as your name, email address and phone number;
  • Your professional details, such as the name of the company you work for and VAT-number;
  • Your installation activity, such as the time and location of the installations you have performed for Duco.

Why do we process this information?

  • We process your information to ensure you can optimally access and use the Application, as required for establishing and maintaining our contractual relationship.
  • We may also process your information to maintain and improve the security of the Application and to analyse and improve the content and functionalities of the Application.

Who has access to your data?

  • Access to your information for the aforementioned purposes will be granted exclusively to specifically authorized staff members of Duco who require such access.
  • In addition, we may commission a third party to process your data, such as but not limited to IT security, digital solutions and web hosting suppliers. However, these parties will only process your information upon our instructions and will need to enter into a data processing agreement with Duco that includes adequate safeguards.

What do you control?

At any moment, you can request to modify, erase or get a copy of your data. To do so, send us an email to installersupport@duco.eu and follow the procedure as described in our full Privacy Notice under Article 4.7.

What do we do to protect your data?

  • We adopted appropriate safety measures on a technical and an organizational level.
  • Your data is stored on high-security servers within the European Union.
  • We have implemented internal procedures to ensure the confidentiality of our IT-infrastructure and to make sure it is managed responsibly.

Duco Installation Application Full Privacy Notice

Duco makes it a matter of utmost importance to respect the privacy of the users of the Duco Installation Application (hereinafter the “Application”). We are committed to treat your Personal Data in the strictest confidentiality, in accordance with the data protection legislation in force and the present Privacy Notice (hereinafter the “Privacy Notice”).

This Privacy Notice is intended to inform you, in a transparent manner, about the data we collect, the purpose for collecting it, the way we use it and the rights you have regarding the processing of such data in relation to the Application.

While you are not obliged to provide us with your personal data, please note that in certain circumstances, declining to provide certain personal data may impact or render impossible our ability to fulfill your requested business activities, provide you with the Application and/or execute our contractual relationship.

Duco reserves the right to change, modify and update this Privacy Notice from time to time by posting a revised version in the Application. Therefore, we recommend you regularly consult this Privacy Notice, to make sure that you are aware of all changes.

Article 1 - GENERAL

Vero Duco NV, (hereinafter, “we”, “us”, “our”, “Duco”), with registered office at Handelsstraat 19, 8630 Veurne, Belgium, and registered with the Legal Entities Register under business registration number BE 0456.974.225, takes responsibility for the processing of your Personal Data as a “data controller”, with regard to the use of the Application.

In our Privacy Notice, “Personal Data” shall mean any information relating to you as an identified or identifiable natural person and user of the Application.

Duco processes Personal Data in accordance with the legislation in force, including but not limited to the EU Regulation 2016/679 of 27 April 2016 on the protection of individuals with regard to the processing of Personal Data and the free movement of such data (hereinafter the “GDPR”) and the national legislation implementing the GDPR.

1.4

The access to or use of the Application implies your full and unreserved understanding of this Privacy Notice. This means that you acknowledge that you were fully informed on how Duco processes your Personal Data, in accordance with the provisions of this Privacy Notice.

Article 2 – WHAT DATA DOES DUCO PROCESS AND WHY

2.1

We only process your Personal Data when we have a specific purpose and lawful basis to do so and only process what is relevant for the pursuit of each specific purpose in question, in particular:

Additionally, usage metrics are collected in order to support and improve the performance of the Application and to ensure its security.

Necessary for the performance of the agreement we have entered or are about to enter into with you and/or your employer as an installation provider (Data Processing Agreement & Terms of Use).

Legitimate interest of Duco to support and improve the performance of the Application and to ensure its security.

Your installation activity The time and location of the installations you have performed and registered on behalf of Duco. To enable the (registration of) the installation of Duco devices, in accordance with the execution of our contractual relationship (Data Processing Agreement & Terms of Use). Necessary for the performance of the agreement we have entered or are about to enter into with you and/or your employer as an installation provider (Data Processing Agreement & Terms of Use).
Your communications Information about the communication you had with Duco in relation to the Application, including technical details and content, e.g. when you had a problem with the Application and asked for support. To ensure we can manage your request and enable an optimal use of the Application (in accordance with the execution of the agreement). Necessary for the performance of the agreement we have entered or are about to enter into with you and/or your employer as an installation provider (Data Processing Agreement & Terms of Use).

2.2 Direct Marketing

We will only use your Personal Data for direct marketing purposes if you have actively consented to such use or based on our legitimate interest to promote products or services that are identical or similar to those to which you have already subscribed.

When you gave us your consent for direct marketing purposes, you have the right to withdraw such consent at any time by clicking the unsubscribe button below every promotional email or by contacting us via: installersupport@duco.eu.

2.3 Transfer to third parties

Duco treats Personal Data as confidential and will not share them with third parties under any condition or for any purpose other than those specified in this Privacy Notice, or when legally required to do so.

Duco may disclose your Personal Data to third parties to the extent that this is necessary to carry out our business activities, including but not limited to suppliers and service providers that offer services related to IT-support, hosting, computer security or other specific services. In any case, these third parties will not share your Personal Data with other third parties, except in the following situations:

  • such third parties need to share your Personal Data with their suppliers or subcontractors to be able to carry out our business activities;
  • such third parties are legally required to share certain information or documents with the competent authorities.

We may also share your Personal Data with your employer, if and to the extent necessary, to verify your request to become a verified Duco installer. This is done to ensure the accuracy and legitimacy of the verification process. Rest assured that we only share the information required for verification purposes and take appropriate measures to protect the confidentiality and security of your data.

Additionally, Duco may share your Personal Data with trusted business partners, who will be bound by contractual obligations to handle your Personal Data in a manner consistent with applicable data protection laws. The details of these business partners will be accessible on the Duco website or via other appropriate communication means, ensuring that you are duly informed about the sharing of your data, unless confidentiality restrictions prevent the disclosure of specific business partnerships.

Duco will not sell or hire out your Personal Data to third parties, except in the situations described in this Privacy Notice or unless you provide your prior consent.

2.4 Legal requirements

In exceptional circumstances, it may be necessary for Duco to transfer your Personal Data in compliance with a court order or to fulfill legal obligations imposed by imperative laws and/or regulations. Duco will make reasonable efforts to inform you or your employer in advance, unless such disclosure is restricted by legal constraints.

Article 3 – RETENTION PERIODS

Duco will store your Personal Data for the duration necessary to achieve the purposes listed in Article 2 of this Privacy Notice. This includes the duration necessary for the contractual relationship between you and/or your employer and Duco.

Additionally, Duco may store your Personal Data to meet legal obligations and comply with applicable laws, even after the termination of the contractual relationship with you and/or your employer. As a result, the retention periods specified below may not apply if legal requirements mandate shorter or longer storage durations. These legal obligations may include statutes of limitation for invoicing, payment, accounting, tax, and regulatory compliance.

Your communications We keep your communications through our Services as long as it is necessary to communicate with you, which is never longer than three years after the first request or contact. In case of a contractual relationship, we will not keep your communications for longer than five (5) years after the end of the contractual relationship or our last communication.

Article 4 – YOUR RIGHTS

4.1 Right of access and right to obtain a copy

At any time, you have the right to freely obtain access to your Personal Data, as well as to be informed about the purpose of the processing.

4.2 Right to rectification, erasure or restriction

You always have the right to ask to rectify your Personal Data when you think it is inaccurate.

You can also request the processing of your Personal Data to be restricted if you think that your data is inaccurate, and you subsequently have made notification of this.

In addition, you have the right to ask to erase your Personal Data in as far it is not possible to anonymize it.

4.3 Right to object

You have the right to object to the processing of your Personal Data when you have and provide serious and legitimate reasons to do so.

You also have the right to object to the use of your Personal Data for direct marketing purposes. In such case, you do not need to provide a specific reasoning for your objection.

4.4 Right to data portability

You have the right to obtain your Personal Data, which is processed by the Application in a structured, commonly used format and/or to transfer this data to another data controller.

4.5 Right to withdraw consent

When the processing of your Personal Data is based on your prior consent, you have the right to withdraw this consent at any time.

4.6 Automated decisions and profiling

You have the right to request not to be subject to a decision based solely on automated processing, including profiling, which produces legal effects concerning you or similarly significantly affects you.

You can exercise your rights by contacting us with a copy of the essential parts of your ID, such as name and date of birth, as attachment:

This is without prejudice to proceedings before the civil courts. If you are from an EU Member State other than Belgium, you may also file a complaint with your national data protection authority (a list of the data protection authority for each EU-member state can be found here.

If you have suffered damage as a result of the processing of your Personal Data, you may file a claim for compensation.

Article 5 – SAFETY AND CONFIDENTIALITY

Duco has adopted safety measures which are suited on a technical, organizational and physical level to avoid the destruction, the loss, the forgery, the adjustment, the non-authorized access or the notification of the Personal Data by accident to a third party, as well as the non-authorized processing of these data.

Nevertheless, if these events would occur and would affect your Personal Data, Duco will inform of the breach without undue delay, including a summary description of the potential impact and a recommendation on measures to mitigate the possible adverse effects of the breach.

Ducoshall not be liable in any way for direct or indirect damages caused by a wrongfully or improper use of the Personal Data by a third party.

You also share the responsibility for upholding the privacy and security of the Application. This includes taking precautions to prevent any unauthorized access or disclosure of your Personal Data and confidential communication(s).

Article 6 – APPLICABLE LAW AND JURISDICTION

This Privacy Notice is managed, interpreted and executed in accordance with Belgian law which exclusively applies to every potential dispute.

The courts of Veurne have exclusive jurisdiction to settle any dispute arising out of or in connection to the interpretation or execution of the present Privacy Notice.
